You have probably heard of Delta 8 THC’s sister cannabinoid, Delta 9 THC. Delta 9 is the more well-known of the two and the one found in high levels in marijuana. Delta 8 THC, however, is found in small amounts in the hemp plant and must be created by converting CBD and other cannabinoids into Delta 8 THC to be economically viable.
The Farm Bill of 2018 made all hemp-derived products legal on a federal level as long as they do not contain more than 0.3% Delta 9 THC by dry weight. Any product that contains more than this level of Delta 9 THC is considered a marijuana product and is, therefore, federally illegal and a Schedule 1 narcotic.
Because the specific wording of The Farm Bill points to only Delta 9 THC as the illegal cannabinoid, Delta 8 THC is placed in the same category as CBD and other cannabinoids. This means that Delta 8 THC is legal on a federal level. However, each state can either adopt the federal government’s laws and guidelines or create its own. The fact that California, Colorado, and other states have legalized marijuana use, even though it is federally illegal, is a perfect example of this. In the same vein, 11 states have made Delta 8 THC illegal to use within their borders, even though it is completely legal federally. Therefore, you should always check for the most up-to-date laws in your state before purchasing or using Delta 8 THC products.
